Please read these Terms carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms.

2. General Store Terms

  • By agreeing to these Terms, you represent that you are at least the age of majority in your country or jurisdiction of residence.

  • We reserve the right to refuse service to anyone for any reason at any time.

  • You agree not to reproduce, duplicate, copy, sell, or exploit any artwork, image, digital content, or portion of the Service without express written permission from us.

3. Artwork Presentation & Colour Accuracy

  • We make every effort to display as accurately as possible the colors, textures, and details of our original artwork and fine art prints.

  • However, as computer monitors, mobile screens, and ambient lighting vary, we cannot guarantee that your device’s display of any color will be 100% accurate to the physical artwork or print paper stock.

  • Fine art prints are produced using archival Giclée techniques on premium paper stock. Minor variations in texture or paper tone are natural characteristics of high-quality printmaking.

4. Pricing & Payment

  • All prices displayed on our website are in GBP (£) unless stated otherwise.

  • We reserve the right to change prices or modify products at any time without prior notice.

  • Payment must be made in full at the time of placing an order. We accept payments securely via credit/debit cards (Stripe) and PayPal. Orders will not be processed or dispatched until payment has cleared.

5. Order Fulfillment & Shipping

  • Print-on-Demand Fulfillment: Fine art prints and framed prints are custom made to order and fulfilled in partnership with our print supplier, Prodigi. Production times may vary depending on the item and destination.

  • Shipping Destinations: We ship within the UK and internationally. Estimated delivery times provided at checkout are estimates only and are not guaranteed delivery dates.

  • Customs & Import Duties: For international orders outside the United Kingdom, the customer is responsible for any import duties, taxes, or clearance fees levied by local customs authorities.

6. Cancellations, Returns & Refunds

A. Fine Art Prints & Physical Items

In accordance with UK Consumer Contracts Regulations, you have the right to cancel or return standard physical orders within 14 days of receiving your item.

  • To initiate a return, please contact us at enquiries@silvertree-art.co.uk within 14 days of delivery.

  • Returned items must be unused, in their original condition, and in their original packaging.

  • The customer is responsible for return postage costs unless the item arrived damaged or defective. We recommend using a tracked shipping service.

B. Damaged or Faulty Goods

If your artwork or print arrives damaged in transit:

  1. Please notify us within 48 hours of receiving the package at enquiries@silvertree-art.co.uk

  2. Include photograph(s) of the damaged packaging and the affected artwork.

  3. Upon verification, we will arrange a free replacement or issue a full refund.

7. Intellectual Property & Copyright

  • All rights reserved: All artwork, designs, imagery, text, and original content on this website are the sole intellectual property of Mark Donoghue.

  • Purchasing an original artwork or fine art print grants you ownership of the physical piece, but does not transfer copyright or reproduction rights. You may not reproduce, scan, print, or redistribute any artwork or images for commercial or public use without explicit written consent.

8. Limitation of Liability

To the fullest extent permitted by law, silvertree art shall not be liable for any indirect, incidental, or consequential damages arising out of the use of our website, delay in shipping, or performance of our products.

9. Governing Law

These Terms and Conditions and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising shall be subject to the exclusive jurisdiction of the courts of England and Wales.
